Since the 1980s, when Canada Mortgage and Housing Corporation (CMHC) ended its consumer protection role through new home construction inspections, housing quality has suffered. For instance, CMHC estimates that more than 65,000 homes in B.C. suffered serious water infiltration problems in B.C.’s leaky condo crisis of the 1990s – a crisis that continues to this day. While B.C.’s crisis is perhaps the best known disaster in Canadian history, defective new homes are a serious problem across Canada. The majority of construction tasks (foundation, framing, plumbing, electrical, etc.) are usually subcontracted out to the lowest bidder, with speed, not quality being an important consideration for the new home builder. With many separate activities going on at the same time, it's nearly impossible for the builder to monitor all phases of the new home construction. In 2005, the Canadian Home Builders’ Association (CHBA) estimated that 10 per cent of Canada’s new home builders are problematic. Other estimates find 20 per cent to 25 per cent of new home builders as problematic. Although there are good new home builders in Canada, consumers and Realtors have no reliable means of knowing who they are. Consumers who find themselves with a defective new home and an unresponsive new home builder naturally turn to their new home warranty program for assistance. This too can be problematic. In Ontario new home purchasers face a mandatory payment to TARION for new home warranty coverage. Purchasers should recognize TARION as an insurance company that will require that you prove your claim. TARION does not serve as an advocate for new home purchaser. The TARION claim process is complicated, and, therefore, must be pursued with great care in order to avoid pitfalls. Municipal government officials involved in the new home construction process usually acknowledge home construction industry and new home warranty program problems, but often simply advise the homeowner that they can settle their issues through civil litigation. Given the time and high costs involved in the legal system with no guarantees of success, the courts are not a viable option for most Canadians. Given a system that is not conducive to construction dispute resolution, many new homeowners conclude that they have no option but to quietly sell their flawed homes without disclosing the known problems to potential purchasers, despite the fact that sellers are required by law to disclose known defects. New home buyers protect their investment by retaining a competent registered home inspector to inspect the new home. While some problems may remain hidden behind drywall,a trained registered home inspector can often detect problems unrecognizable to the average consumer.

ENVIRONMENTAL SITE ASSESSMENT Acceptable by ALL Commercial Lenders / Banks in Ontario
Phase 1 - Environmental Site Assessment Environmental Site Assessment is a thorough environmental analysis of a commercial property and all surrounding uses or conditions, which may carry the risk of contamination or liability and issues arise from past and present use of chemical, oil tanks, asbestos and other hazards. Assessments have been performed on a range of commercial properties including gas stations, medium sized industrial operations and multi-tenant commercial plazas. As described by the Canadian Standards Association (CSA), in Standard CAN/CSA-Z768-01, a phase 1 environmental site assessment is a systematic process by which an assessor seeks to determine whether a particular commercial property is subject to actual or potential contamination. The scope of the phase 1 environmental site assessment will consist of the following four principal components of the CSA Standard: 1. Review of historical land use, occupancy records, and aerial photographs. 2. Visual assessment of the property and surrounding properties including identification of any liquid or chemical storage, PCBs, ACM, Lead and other designated substances, spills or soil and building contamination and identification of surrounding land use in order to identify possible impacts to the subject site. 3. Interview with persons having knowledge of past and present site activities. 4. Evaluation of Information and Reporting Phase 1 Environmental Site Assessment can be arranged within 6~8 business days. Phase 2 - Environmental Site Assessment A Phase 2 Environmental Site Assessment (ESA) is an investigation to confirm the presence or absence of contamination on a property. It is accomplished by a sampling and analysis program that may include: • soil drilling and/or test pitting; • geophysical analysis; • surface or groundwater sampling; and • testing of building materials
Generally, a Phase 2 Environmental Site Assessment is required by a lending institution (bank) when potential contamination has been identified on a high-risk property such as gas stations, dry cleaners etc,requiring financing. The potential contamination is often identified throughan initial phase 1 environmental site assessment. If contamination is identified, the Phase 2 Environmental Site Assessment findings are used to develop options for dealing with the contamination including removing the contamination, managing the contamination in-place and or monitoring soil and groundwater conditions to ensure the contamination doesn’t worsen. The cost, scope and duration of a Phase 2 Environmental Site Assessment are dependent on many factors such as the size and location of the site, the number and type of suspected contaminants, the type of material to be sampled (e.g., soil, groundwater, etc.), the methods used for sample collection and the time required to obtain laboratory results. The turnaround time for a typical Phase 2 Environmental Site Assessment is about 2 - 4 weeks. Cost from $5,950
Energy Audit Pre-retrofit energy audit fee $350. Ontario Home Energy Audit Program will issue a $150 rebate cheque to the homeowner for the pre-audit. A homeowner is not required to carry out a retrofit to receive the rebate. If the homeowner chooses to pursue the recommendations in the audit, they could be eligible for the federal & provincial governments’ ecoENERGY retrofit grant program.
